Terms of Service

CreateCrew operates as an intermediary under Section 79 of the Information Technology Act, 2000 and complies with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. These Terms govern your use of the Platform.

1. Acceptance of Terms

By accessing or using CreateCrew ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. CreateCrew is operated from India and is currently focused on serving users within India, although the Platform may be accessible globally.

2. Description of Service

CreateCrew is a marketplace that connects content creators (Creators) with skilled freelancers (Crew) in the Indian creator economy. The Platform facilitates discovery and connection — Creators can post jobs and browse freelancers, while freelancers can create service listings (gigs) and apply to jobs.

CreateCrew does not currently handle payments, contracts, or dispute resolution between users. All financial arrangements and work agreements are made directly between Creators and Freelancers outside the Platform. CreateCrew is not a party to those arrangements.

3. User Accounts and Eligibility

  • You must be at least 18 years old. By signing up, you represent that you are of legal age to form a binding contract under the Indian Contract Act, 1872.
  • You must sign in using a valid Google account.
  • You are responsible for all activity under your account.
  • You may register as a Creator, Freelancer, or both.
  • You must provide accurate information during onboarding and keep your profile up to date.
  • You must not create multiple accounts, evade bans, or impersonate others.
  • You agree to receive transactional emails related to your account.

4. Prohibited Content and Conduct

You may not post content, create listings, send messages, or use CreateCrew to create or solicit:

  • Sexual content, nudity, or NSFW imagery.
  • Material involving minors in any sexual or exploitative context — we report such material to law enforcement and preserve evidence.
  • Deepfakes or AI-generated synthetic media depicting real people without their explicit consent.
  • Content that infringes copyright, trademark, or other intellectual property rights.
  • Illegal services — including but not limited to drugs, weapons, fraud-for-hire, paid harassment, vote manipulation, or evasion of platform safety.
  • Doxxing, harassment, threats, or content targeting individuals or groups based on protected characteristics.
  • Impersonation of real creators, brands, public figures, or other CreateCrew users.
  • Fake portfolios, work passed off as your own that you did not create, or fabricated reviews.
  • Spam, mass-applied identical proposals, scraping, automated tools, or coordinated inauthentic activity.
  • Off-platform payment or contact schemes specifically intended to evade platform safety features.
  • Content that violates any applicable Indian law.

You also agree not to use contact information obtained through the Platform for unsolicited marketing, attempt to circumvent security measures, or access other users’ accounts without authorization.

5. Content Ownership

You retain ownership of all content you post on CreateCrew (gig descriptions, portfolio samples, job posts, proposals). By posting content, you grant CreateCrew a non-exclusive, royalty-free, worldwide license to display, distribute, and process that content on the Platform for the purpose of operating the service.

6. Intellectual Property Notices

If you believe content on CreateCrew infringes your intellectual property rights, send a notice to support@createcrew.online including: (i) proof of ownership, (ii) the URL or identifier of the offending content, (iii) a good-faith statement that the use is unauthorized. We will act on valid notices within 36 hours as required by Rule 3(1)(d) of the IT Rules, 2021. Counter-notices may be submitted to the same address.

7. Limitation of Liability

CreateCrew is a discovery and connection platform. We do not guarantee the quality of work, reliability of users, or outcome of any Creator-Freelancer engagement. The Platform is provided "as is" and "as available" without warranties of any kind.

To the maximum extent permitted by Indian law, CreateCrew is not liable for indirect, incidental, consequential, or punitive damages. Our total aggregate liability is limited to the lower of (a) ₹1,000 or (b) any fees you paid us (currently nil during beta). This limitation does not apply to liability arising from gross negligence or willful misconduct.

8. Account Suspension and Termination

You may delete your account at any time through Settings, provided you have no active jobs, gigs, or pending proposals. See our Privacy Policy §6 for what happens to your data after deletion.

We may suspend or terminate your account for any of the following:

  • Violation of §4 (Prohibited Content and Conduct).
  • Repeated reports against your content or behavior on the Platform.
  • Impersonation or identity fraud.
  • Attempts to evade an existing suspension or to operate multiple accounts.
  • A valid court or law enforcement order.

Appeal: If your account is suspended, you may appeal by emailing support@createcrew.online within 30 days of the action. We will respond within 15 days.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app banner or email at least 7 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the new terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with the Platform shall first be attempted in good faith via email to support@createcrew.online for a minimum of 30 days. If unresolved, the courts of Hyderabad, Telangana shall have exclusive jurisdiction.

11. Grievance Officer

Per Rule 3(2) of the IT Rules, 2021, our Grievance Officer can be reached at support@createcrew.online. Complaints will be acknowledged within 24 hours and resolved within 15 days.

12. Force Majeure

We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, infrastructure outages by our service providers, or actions of governmental authorities.
